SERVERCLUB POS SYSTEM – USER AGREEMENT
Effective Upon First Use of the Application or Website
1. SERVICE AGREEMENT
Client Support Contact
All ServerClub POS System plans include complimentary chat and written support during standard support hours. If specified in your plan, telephone support is also included. Support inquiries should be submitted through the control panel or via the registered email address. Basic support services are included in the package price.
Advanced support requests outside the standard service scope may be addressed on a case-by-case basis. If a request requires more than 15 minutes of support time, ServerClub.LK Pvt Ltd (hereafter referred to as “ServerClub”) may charge a fee of $10 USD or LKR equivalent per 15-minute increment, subject to client approval.
2. SYSTEM MAINTENANCE AND DOWNTIME
ServerClub will communicate scheduled maintenance and known outages in advance via email. Clients may subscribe to receive system status updates by email. Every effort is made to maintain consistent system availability.
3. DATA & CONTENT MANAGEMENT
All actions by the ServerClub support team involving modification, deletion, or transfer of data/content within your POS system will only be performed with explicit consent or instruction from the client. It is the client's responsibility to regularly back up all sensitive and operational data.
4. APPLICATION MODIFICATIONS & THIRD-PARTY INTEGRATIONS
Customization of core application features, including backend system files and configurations, is not supported unless explicitly agreed upon. Integration with third-party services is limited to those officially supported by ServerClub.
5. GENERAL TERMS – SCOPE OF APPLICATION
These Terms and Conditions govern all use of the ServerClub POS System and related services. They apply to all current and future interactions between the Customer and ServerClub. Customer terms and conditions are not applicable, even if not explicitly rejected by ServerClub.
We reserve the right to update these terms, system policies, and pricing at any time, with prior notice provided via email or client dashboard.
Verbal assurances or agreements from employees or third-party agents of ServerClub are not binding unless confirmed in writing.
6. GENERAL TERMS – SCOPE OF SERVICES
The scope of services is determined by the official product description at the time of order. ServerClub reserves the right to amend or discontinue any free services and introduce charges with prior notice.
We aim to maintain a 99.9% average annual network uptime across our data centers. Technical support beyond the standard service description will be invoiced separately.
7. PAYMENT TERMS AND LATE FEES
Invoices are issued based on the current pricing listed on our website or within your account. Charges may include taxes, shipping (where applicable), and handling.
Billing cycles may be monthly, quarterly, or annually, depending on your selected plan. The customer agrees to adhere to the terms of the chosen payment method.
ServerClub reserves the right to charge interest on overdue payments starting from the due date, without the need for a prior reminder.
All taxes and transaction-related fees are the responsibility of the customer. Invoices are provided in electronic format free of charge; postal delivery is available for an additional fee.
8. ADMINISTRATOR RIGHTS & DATA SECURITY
Full Administrative Control:
The client retains complete administrative rights over their ServerClub POS account. This includes, but is not limited to:

Creating, modifying, and deleting users

Managing security settings, roles, and permissions

Accessing all data and system configurations

Monitoring system activity and auditing logs

Managing subscription and billing settings
ServerClub will not access or alter customer data without express consent.
9. LIABILITY & LIMITATIONS
For managed ServerClub POS services, clients are granted basic rights of usage. While our team monitors server performance 24/7, ServerClub provides complimentary support only for standard services.
Use of the ServerClub POS System is at the sole risk of the customer. ServerClub shall not be liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, business interruptions, or data loss.
